Terms and Conditions
We suggest that you carefully read the terms and conditions that are detailed below as this forms the basis of the sale agreement between you and Luv Baby when you purchase goods from our website. If you proceed with your purchase you are acknowledging that you have read these terms and conditions of sale and that you acknowledge that your purchase from us is subject to these terms and conditions. We have attempted to keep the text in simple to understand language. If any part is confusing or not clear, please contact us.
Please note that from time to time, these terms and conditions may change. We therefore recommend that you review these terms and conditions on a regular basis to identify any changes that may affect you.
Payment & Pricing
All prices are listed in Australian Dollars and include GST. The prices indicated exclude delivery and handling unless specifically stated in the product description. Prices are subject to change without notice. Luv Baby will at all times use our best efforts to ensure that the prices on our website are accurate at any point in time. The prices that are displayed on the website are only current at that particular point in time and we reserve the right to change our prices at any time without prior notice.
If a price changes on the Luv Baby website before you place your order, Luv Baby at its discretion, reserves the right not to honour this price.
The Luv Baby website prices and offers may vary from in store prices due to website specific sales and promotions.
We accept payment via PayPal and direct Bank Transfer. No credit card information is shared by this site.
Goods and Services Tax (GST)
Goods and services tax is applicable on all our products, all prices include GST. The current rate of GST is 10%. This rate may change in the future and will be based on Australian legislation. The prices indicated for products exclude freight and handling unless otherwise stated.
Title for goods ordered on our site will pass to you when we receive payment in full for your order.
Shipping and Delivery Policy
We deliver products Australia wide using a wide range of couriers. Shipping costs are influenced by the size and weight of the product and location, exact shipping costs are calculated in the shopping cart and will be added to the order total before checkout. Orders are dispatched within two business days and shipping times are estimated at between 3-7 business days depending on your location within Australia. Larger items, i.e. cots and furniture, are unique in size in terms of freight handling and delivery location. Due to this, prices need to be individually quoted. If purchasing multiple items, freight charges may be reduced depending on individual circumstances. Please email to us, any queries regarding multiple items, so that a correct freight charge can be quoted. If the items you have ordered are out of stock, you will be notified within two days, and given an expected date of arrival or a full refund. Please take note: when ordering furniture, delivery times may take up to twelve weeks depending on supplier availability.
At Luv Baby we try to provide the largest possible range of products available to purchase but it is not always possible to keep all advertised products on our website in stock due to various factors such as colour way, supplier availability, space, turn over and more.
In the event that a product you have ordered is temporarily out of stock at our warehouse we will notify you by email within 2 business days advising the estimated time for new stock arriving and your order being dispatched. If you cannot wait for your order to be filled we will offer you a refund or an alternative where possible.
Temporarily out of stock / Back Orders
Some products such as but not limited to furniture and mattress items are not always held in stock but are ordered through the manufacturers or suppliers and are subject to the delivery time frames and product availability of those suppliers. If such a product is on Back Order with a supplier (the manufacturer/supplier is temporarily out of stock) the estimated delivery times are approximate only and may change, where this is the case we will advise you by email where possible if the estimated delivery time changes. It is advisable to allow up to 12 weeks for Back Order items to be available for dispatch though most items are shipped much sooner.
Incorrect Goods Supplied
If we supply you with an incorrect product, we will supply you with the correct product once the incorrect product has been returned. In the event of a wrong product being supplied, you must contact us within 48 hours of receiving your goods. Luv Baby will reimburse the cost of returning the product.
Products Damaged in Transit
All orders from our website will be delivered by independent courier companies. These couriers will use their best endeavours to supply you with the product you have ordered in good condition. If goods are damaged in transit, you will need to contact us by email within a reasonable period of time after receiving your goods. We will supply you with a replacement product once the damaged product has been returned. Luv Baby will reimburse the cost of returning the product.
Products Lost in Transit
All orders from our website will be delivered by independent courier companies. These couriers will use their best endeavours to deliver you products within 7 days of dispatch. If after 7 days from the date of your order being dispatched your order has not been delivered, you will need to contact us by e-mail. We will immediately commence an enquiry with the courier company concerned. If after 10 days from the date of your notification to us the goods cannot be located, we will supply you with a replacement product.
We respect your choice to shop with Luv Baby and if for any reason you wish to return the product to us, you can do so within 7 days from the purchase date, providing the product is unused, in its original undamaged packaging and with the original receipt.
At Luv Baby we want you to be completely happy with your purchase, if for any reason you wish to return a product to us please contact us first.
To return an item:
1. The item must be unused, in its original packaging (packaging must in no way be damaged), hygiene and security seals intact where applicable and be in reselable condition.
2. Include a note advising your reason for return, including a copy of your receipt and a contact email address.
3. Return the item to us within 7 days of receiving the product, ensuring that the item is packaged so the product is not damaged in transit back to us otherwise a return may be refused.
Note – We suggest the item should be returned by receipted or express post as we cannot be held responsible for any product lost or damaged in transit.
4. Address to: Luv Baby 164 Lake Road Port Macquarie NSW 2444 within 7days of receiving the item.
5. The cost of return delivery for the product is your responsibility.
6. Once we receive the returned product, allow 3 business days for us to inspect the product for resale and issue you with a refund or Credit Voucher number to the value of the goods – Credit Vouchers are valid for 6 months.
Please note that we do not accept returns on Special Orders, personal hygiene products, breast pumps, products without security seals and car seats. Furniture items incur in a 30% restocking fee. Unfortunately we do not offer refunds due change of mind or incorrectly ordered items.
These are in addition to statutory warranties which cannot be excluded under the Australian Consumer Law. Manufacturer warranty periods are as stated for each individual item. A manufacturer’s warranty begins from the date of invoice, not the date of first use. If you make a claim under a Manufacturer’s warranty, you must pay for the cost of returning the product to Luv Baby and for the cost of having it delivered to you after repair, exchange or refund (as the case may be).
Warranties cover manufacturing faults only and do not cover misuse or wear and tear, please see your product manual for full warranty inclusions as they differ between products. Other Manufacturer warranty details are as stated for each individual item.
For a Warranty Claim after the first year of purchase, please contact the manufacturer directly with your concern.
To process a Warranty Claim within the first year from purchase date:
1. Email us at firstname.lastname@example.org with a copy of your receipt, a description of the issue, a photo of the faulty product/issue and your complete contact details including contact email.
2. We will advise you by return email what the next step is which is on a case-by-case basis.
Luv Baby and its suppliers reserve the right to assess the condition of the faulty goods prior to offering a repair or replacement. We will do our best to advise of the most economical means to have the issue resolved in a timely manner. This may result in the product being sent back to us, approved repair agent or supplier for assessment, with all costs for transporting the faulty item for assessment being incurred by you.
Refunds and Credit Notes
In the event of products not being available for supply to you after your order has been placed with us we will issue you with a credit note or refund for either part of the order or for the entire order.
All refunds will be made the same way as the original payment method was made in favour of the person or entity on the original transaction.
